Who Can File for Chapter 7 Bankruptcy?

If you are seeking a debt discharge, you must first qualify to file Chapter 7 through the means test, which assesses your income and expenses.  In general, Chapter 7 bankruptcy is a debt-relief solution for people who:

- Owe significant unsecured debt
- Are having difficulty making ends meet
- Have no money left after paying monthly bills
- Experienced a loss of income or have a lower income
 

 

 

Who Can File for Chapter 13 Bankruptcy?

Any individual with a regular income who owes less than $336,900 in unsecured debt and $1,010,650 in secured debt may file a Chapter 13. The debts must be non-contingent and liquidated, meaning that they must be for a certain, fixed amount and not subject to any conditions.  However, corporations and partnerships may not file, and if you filed a prior bankruptcy petition and the prior proceeding was dismissed within the last 180 days, you may not be able to file a second petition.
